1. Orders

• All orders are subject to acceptance by Tempering Foods LLC.
• Orders may be placed by phone, email, or approved ordering platform.
• Minimum order requirements may apply.
• Product availability is subject to inventory.

2. Pricing

• Prices are subject to change without prior notice.
• The price in effect on the invoice date will apply.
• Promotional pricing is valid only during the stated promotion period.

3. Delivery

• Delivery schedules are estimates and are not guaranteed.
• Customers are responsible for ensuring someone is available to receive deliveries.
• Ownership and risk of loss transfer to the customer upon delivery.

4. Frozen Product Handling

• Ice cream and frozen products must be stored at 0°F (-18°C) or below immediately upon delivery.
• Once products are delivered and accepted, Tempering Foods LLC is not responsible for damage resulting from improper storage, freezer failure, power outages, or mishandling.

5. Inspection & Claims

• Customers must inspect all products at the time of delivery.
• Shortages, damages, or incorrect items must be noted on the delivery receipt and reported within 24 hours.
• Claims made after 24 hours may not be accepted.

6. Returns

• Due to food safety regulations, frozen food products are non-returnable unless:
• Incorrect products were delivered.
• Products arrived damaged.
• Products are defective or subject to a manufacturer recall.
• Approved returns or credits are issued at the sole discretion of Tempering Foods LLC.

7. Product Quality

• Customers are responsible for maintaining proper freezer temperatures.
• Tempering Foods LLC is not responsible for quality issues caused by improper handling or storage after delivery.
